The terms that govern your use of Circuit 41 and Circuit 40s services.
About Circuit 41
Circuit 41 is an international shipping and shipment coordination platform operated by Circuit40s Limited ("Circuit 40s", "we", "us"). The service enables users to create shipments, track parcels, upload documents, and manage payments for international freight and delivery.
By creating an account or using Circuit 41, you agree to these Terms of Service. If you do not agree, do not use the service.
Eligibility and Accounts
You must be at least 18 years old to use Circuit 41. By registering, you confirm that the information you provide — including your name, email address, and any shipment or contact details — is accurate and up to date.
You are responsible for maintaining the security of your account credentials. You must notify us promptly at hello@circuit40s.com if you suspect unauthorised access to your account.
Prohibited Goods
You must not use Circuit 41 to ship goods that are illegal, dangerous, restricted, or misdeclared. This includes but is not limited to:
- Illegal drugs, controlled substances, or items prohibited by applicable law
- Weapons, firearms, explosives, or related components
- Hazardous materials, flammable or corrosive substances not properly declared
- Items that violate export or import controls in the country of origin or destination
- Counterfeit goods, items infringing intellectual property rights
- Goods with inaccurate, misleading, or missing customs declarations
- Any item that is prohibited by the carrier handling the shipment
Submitting a shipment through Circuit 41 is a representation that the contents are legal, accurately described, and compliant with all applicable regulations.
Your Responsibilities
You are responsible for:
- Providing accurate shipment details, parcel contents, weights, dimensions, and addresses
- Ensuring your goods comply with the import and export rules of both the origin and destination country
- Packaging goods adequately to prevent damage during transit
- Supplying all required customs documentation truthfully and on time
- Any duties, taxes, or fees applicable to your shipment
Inaccurate or incomplete information may result in delays, additional costs, customs holds, or rejection of your shipment, for which Circuit 40s bears no liability.
Our Right to Refuse or Hold Shipments
Circuit 40s reserves the right to refuse, hold, cancel, or return any shipment that:
- Appears to contain prohibited, dangerous, or misdeclared goods
- Is in breach of these terms or applicable law
- Has outstanding unpaid amounts associated with it
- Cannot be processed due to incomplete or inaccurate information
- Is flagged by a carrier, customs authority, or regulatory body
Where possible we will notify you of any action taken, but we cannot guarantee advance notice in all circumstances, particularly where legal or safety concerns are involved.
Shipment Timelines
Any delivery timelines, transit estimates, or arrival windows provided within Circuit 41 are estimates only and are not guaranteed. Delivery times can be affected by:
- Customs clearance procedures and inspections
- Carrier schedules, port congestion, or logistical delays
- Weather events, national holidays, or force majeure circumstances
- Incomplete documentation or customs queries requiring resolution
- Third-party handling at any point in the delivery chain
Circuit 40s is not liable for losses arising from delays outside our direct control.
Payments
Payments for shipments are processed through Stripe, a third-party payment provider. By making a payment, you agree to Stripe's terms of service. Circuit 40s does not store full card details.
Bank transfer payments may require manual confirmation before your shipment is processed. Shipments with outstanding balances may be held until payment is received and confirmed.
Checkout within Circuit 41 becomes available once the relevant parcels have arrived and the shipment is ready for payment. Payments already processed for completed shipment stages are generally non-refundable except where required by applicable law or agreed in writing.
Documents and Proofs
Any documents, photos, or proofs you upload through Circuit 41 may be used for:
- Shipment verification and parcel condition records
- Weight and volume assessment
- Customs declarations and regulatory compliance
- Delivery confirmation and proof of receipt
- Dispute resolution and support handling
- Legal, accounting, and operational record-keeping
By uploading documents or images, you confirm they are accurate and that you have the right to submit them.
Account Deletion
You may request account deletion through the Profile section of the Circuit 41 app. Deleting your account removes your login credentials and personal profile from our active systems.
Operational records associated with shipments, payments, or disputes — including uploaded documents — may be retained or anonymised in line with our Privacy Policy and applicable legal obligations. Account deletion does not immediately remove all records from our systems.
Limitation of Liability
Circuit 40s provides the Circuit 41 platform as a shipment coordination and management tool. To the extent permitted by applicable law, our total liability to you for any claim arising from use of Circuit 41 is limited to the amount you paid for the specific shipment giving rise to the claim.
We are not liable for indirect, incidental, or consequential losses, including loss of business, lost profits, or losses caused by third parties (carriers, customs authorities, or other parties in the logistics chain) acting outside our control.
Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Changes to These Terms
We may update these Terms of Service from time to time. We will update the "Last updated" date when changes are made. Continued use of Circuit 41 after updated terms are posted constitutes your acceptance of them. If you disagree with updated terms, you should stop using the service.
Governing Law
These Terms of Service are governed by the laws of England and Wales. Any disputes arising from or relating to these terms or your use of Circuit 41 shall be subject to the exclusive jurisdiction of the courts of England and Wales.
